Version 1.0 · Effective date: 23 September 2026
This End User License Agreement ("EULA") is a legal agreement between the person or entity using the Software ("User") and Beyond It S.r.l., with registered office at Viale Pico della Mirandola 129, 00142 Roma RM, Italy ("Licensor"), concerning Armagammon (the "Software").
By selecting Accept, the User agrees to be bound by this EULA. If the User does not agree to this EULA, the User must not use the Software.
1. License Grant
Subject to this EULA and any applicable Additional Terms, the Licensor grants the User a limited, non-exclusive and non-sublicensable license to install and use the Software.
The Software is licensed, not sold.
The specific scope of a license, including any applicable limits concerning duration, users, devices or other license entitlements, may be defined by Additional Terms or by the license entitlement associated with the Software.
No ownership rights in the Software or its intellectual property are transferred to the User under this EULA.
Unless otherwise specified in the Additional Terms or the associated license entitlement, the license is granted solely for the User's personal, private and non-commercial use.
2. Editions, Entitlements and Additional Terms
The Software may be made available in different editions or with different license entitlements and feature sets.
Certain editions, licenses or entitlements may be subject to additional commercial or licensing terms ("Additional Terms").
Where Additional Terms apply, they form part of the agreement between the User and the Licensor.
If Additional Terms conflict with this EULA, the Additional Terms prevail only with respect to the specific commercial, licensing or entitlement matters that they expressly govern. This EULA otherwise continues to apply.
Nothing in this EULA or in any Additional Terms overrides provisions of applicable law that cannot legally be excluded or modified by contract.
3. Restrictions
Except where expressly permitted by applicable law or applicable Additional Terms, the User may not:
- copy or redistribute the Software except as reasonably necessary for installation or backup;
- modify, adapt or create derivative works from the Software;
- reverse engineer, decompile or disassemble the Software;
- bypass or circumvent technical restrictions, licensing controls or feature restrictions;
- sublicense, rent, lease or otherwise make a license entitlement available to unauthorized third parties;
- use the Software in a way that infringes intellectual property rights or other applicable laws.
These restrictions do not apply where and to the extent that applicable law expressly grants the User the right to perform the relevant activity notwithstanding contractual restrictions.
The User agrees not to use the Software (including its real-time computational or analytical outputs) to engage in illegal gambling, or as an unauthorized assistance tool (Real-Time Assistance / RTA) or automated bot during online matches on third-party platforms, where such use is prohibited by the rules of those platforms or by applicable Fair Play rules.
4. Updates and Modifications
The Software may periodically connect to servers operated by or on behalf of the Licensor to check whether updates are available.
Depending on the Software version, platform and configuration, the Software may notify the User of available updates or may download or install updates automatically. Where controls concerning update behavior are provided by the Software or the operating system, their operation is subject to the corresponding settings.
Updates may include security updates, bug fixes, compatibility changes, performance improvements and new, modified or removed functionality.
Some updates may be necessary to maintain the security, compatibility or conformity of the Software.
The Licensor may modify the Software for valid technical, security, compatibility, legal or operational reasons, subject to the requirements and protections established by applicable law.
Nothing in this section limits any mandatory rights of the User concerning updates, modifications, notice, conformity or termination.
5. User Data
The Software may create or store local files containing preferences, matches, positions, analyses, collections or other data created or generated by the User.
Except where expressly stated otherwise, the User is responsible for maintaining appropriate backups of data that is important to the User.
Neither the Licensor nor the copyright owner acquires ownership of content or data created by the User merely because such content or data is processed or stored by the Software.
The User's responsibility for maintaining backups does not exclude or limit any liability of the Licensor that cannot legally be excluded or limited.
6. Network Access and Privacy
Some functions of the Software may require network access, including functions related to software updates or license management.
Any processing of personal data in connection with the Software is described in the applicable Privacy Policy.
This EULA does not replace any privacy notice or other information that the Licensor is required to provide under applicable data protection law.
7. Third-Party Components
The Software may include or use software, libraries, assets or other components provided by third parties.
Such components may be subject to separate open-source or third-party license terms.
Where required, applicable licenses, copyright notices and attribution notices are made available with the Software or through a Third-Party Notices document.
Third-party components remain subject to their respective license terms and intellectual property rights independently of this EULA.
8. Intellectual Property
The Software and its original source code and materials are protected by copyright and other applicable intellectual property laws.
Copyright in the original Armagammon software authored by Alessandro Scotti is owned by Alessandro Scotti.
The Licensor is authorized by the copyright owner to distribute the Software and to grant end-user licenses under this EULA.
Certain components, assets or other materials included in or used by the Software may be owned by or licensed from third parties or other rights holders. Their respective rights are not transferred or affected by this EULA.
"Armagammon" and associated names, logos and branding may not be used in a manner that suggests endorsement, sponsorship or affiliation without permission from the relevant rights holder.
9. Availability, Support and Future Development
The Licensor may release updates, fixes and new versions of the Software from time to time.
Unless required by applicable law or expressly provided in applicable Additional Terms, this EULA does not create a commitment to provide any particular support service, development roadmap, release schedule, new feature or continued development of the Software.
This section does not affect any obligation to provide updates or maintain conformity where such obligation arises under applicable law or under the terms governing a particular license.
10. Warranties and Consumer Rights
The Software is provided subject to all conformity requirements, warranties and other rights that apply under mandatory law.
To the maximum extent permitted by applicable law, and without limiting mandatory consumer rights, the Licensor does not guarantee that the Software will be entirely free from defects, interruptions or compatibility issues, or that every analysis or computational result produced by the Software will be error-free.
The Software is a backgammon playing and analysis tool. Evaluations, recommendations, probabilities and other analytical results generated by the Software are computational outputs and do not constitute guarantees of any particular game outcome.
If the User is a consumer, nothing in this EULA excludes or limits statutory rights that cannot legally be waived or restricted by contract.
11. Limitation of Liability
Nothing in this EULA excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including liability that cannot legally be excluded for wilful misconduct, gross negligence, personal injury or other mandatory grounds.
For Users acting in the course of a business, trade or profession, and to the maximum extent permitted by applicable law, the Licensor shall not be liable for indirect or consequential losses, loss of profits, loss of business or loss of data arising from the use of the Software.
Any additional limitations of liability or contractual liability caps applicable to a particular paid license, service or commercial arrangement may be specified in applicable Additional Terms.
Nothing in this section reduces any mandatory rights available to consumers.
The User agrees to indemnify and hold harmless the Licensor, its directors, employees, contractors and the copyright owner from and against any claims, damages, losses, liabilities or expenses (including legal fees) arising from the User's breach of this EULA, misuse or unlawful use of the Software, or violation of any third-party rights or applicable laws.
12. Termination
The User may stop using the Software at any time.
The Licensor may terminate the license granted under this EULA if the User materially breaches its terms and, where the breach can reasonably be remedied, fails to remedy the breach after appropriate notice.
Following termination of the license, the User must cease using the Software and uninstall copies whose continued use is no longer authorized.
Where a license was acquired under Additional Terms, any consequences of termination concerning license entitlements, payments, refunds or other commercial matters are governed by those Additional Terms and by applicable law.
Termination does not affect rights or obligations that arose before termination or any rights granted by mandatory applicable law.
13. Changes to this EULA
The Licensor may update this EULA when reasonably necessary, including to reflect changes to the Software, licensing model or applicable law.
Each version of this EULA is identified by a version number and effective date.
Changes that do not materially affect the User's rights or obligations may be introduced without requiring a new acceptance where permitted by applicable law.
Where changes materially affect the User's rights or obligations, the updated EULA will be presented to the User for review and explicit acceptance before the revised terms become binding on the User.
If the User does not accept updated terms, the User may be unable to use versions, features or services that are made available subject to those terms, without prejudice to any rights the User has under previously applicable terms or mandatory law.
Changes to this EULA do not retroactively remove rights already acquired by the User where applicable law does not permit this.
14. Governing Law and Disputes
This EULA is governed by the laws of Italy.
If the User is a consumer, this choice of law does not deprive the User of any mandatory consumer protection afforded by the law that would otherwise apply, nor does it affect mandatory rules concerning consumer jurisdiction.
If the User is acting for purposes related to a business, trade or profession, any dispute arising out of or relating to this EULA shall be subject to the exclusive jurisdiction of the courts of Rome, Italy, unless otherwise required by applicable law.
15. Severability
If any provision of this EULA is found to be invalid or unenforceable, the remaining provisions remain in effect to the extent permitted by applicable law.
Where possible, the invalid or unenforceable provision shall be interpreted or replaced in a manner that most closely reflects its lawful purpose.
